Welcome to Reel, a social media platform for fishing enthusiasts operated by Shoreline Solutions, a New Zealand limited company ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your use of the Reel mobile application and related services (collectively, the "Service").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. DESCRIPTION OF SERVICE

Reel is a social media platform designed specifically for fisher people in New Zealand. The Service allows users to:

  • Create personal accounts and profiles
  • Log fishing trip details including species caught, fishing methods, and general locations
  • Upload and share photos of fishing trips
  • View publicly shared fishing trips and photos from other users
  • Access weather information through integrated weather services
  • Maintain private trip logs that are not shared publicly

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 Age Requirements

You must be at least 13 years old to use the Service. Users under 18 must have permission from a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

3.2 Account Creation

To use the Service, you must create an account by providing:

  • A valid email address
  • Your name
  • Any other information we may reasonably request

3.3 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your account information is accurate and up-to-date
  • Notifying us immediately of any unauthorised use of your account

4. ACCEPTABLE USE POLICY

4.2 Prohibited Conduct

4.3 Content Standards

All content shared on the Service must:

  • Comply with New Zealand laws and regulations

  • Be appropriate for users aged 13 and above

4.4 Moderation Rights

5. USER-GENERATED CONTENT

5.1 Content Ownership

You retain ownership of all content you upload or share through the Service, including photos, trip logs, and other materials ("User Content").

5.2 License to Company

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, adapt, and distribute your User Content in connection with operating and providing the Service.

5.3 Content Responsibility

You are solely responsible for your User Content and represent that:

  • You own or have the right to use all User Content you upload
  • Your User Content does not violate these Terms or applicable laws
  • Your User Content does not infringe on others' rights

5.4 Public Nature of Content

Unless you specifically choose to keep trip logs private, all User Content shared on the Service is publicly viewable by other users and visitors to the platform.

6. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. THIRD-PARTY SERVICES

The Service integrates with third-party services, including weather data providers. Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Company Rights

The Service, including all software, designs, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9. ACCOUNT TERMINATION

  • Your trip log data may be retained in anonymised or aggregated form for research and service improvement
  • You will no longer be able to access the Service

9.2 Termination by Us

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • We believe your actions harm other users or the Service
  • Required by law or regulatory authorities
  • We decide to discontinue the Service

9.3 Effect of Termination

Upon termination, your right to use the Service ends immediately. Provisions that should survive termination will continue to apply.

10. DISCLAIMERS

10.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee continuous, uninterrupted, or error-free operation of the Service.

10.2 Weather Information

Weather information is provided by third-party services and is for informational purposes only. We do not guarantee the accuracy of weather data and are not responsible for decisions made based on this information.

10.3 User Content

We do not control or endorse User Content and are not responsible for its accuracy, appropriateness, or legality.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by New Zealand law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.
  • Our total liability for any claims arising from or relating to the Service shall not exceed NZD $100.
  • Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.

12. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from:

Trip log data, including fishing records and related information, may be retained in anonymised or aggregated form after account deletion for business records and service improvement. Other personal information is handled in accordance with our Privacy Policy and applicable laws.

14. MODIFICATIONS TO TERMS

We may modify these Terms at any time by posting the updated Terms in the app. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms. We will notify you of material changes through the app or by email.

15. MODIFICATIONS TO SERVICE

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of New Zealand. Before initiating legal action, you agree to first contact us at info@reelapp.tech to attempt to resolve the dispute informally. If unresolved, any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

17. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
